NOTICE IS HEREBY GIVEN that the Willistown Township Zoning Hearing Board will meet on Monday, September 15, 2025, at 7:00 p.m., prevailing time, at the offices of the Township located at 688 Sugartown Road, Malvern, Willistown Township, Chester County, Pennsylvania, to conduct such business as may properly come before the Board and to hold a hearing on the following:
Application Z-10-25: Application of Brian Johnson, which seeks, as amended, variances from §139-36.C(1) (Front yard) and §139-36.C(3)(Rear yard) of the Willistown Township Zoning Ordinance to permit the construction of a detached garage which will encroach approximately 21.5 feet into the 30 foot required front yard setback from First Avenue, and approximately 21.4 feet into the 25 foot required rear yard setback; a variance from §139-90.D (Restoration) to permit the rebuilding of a nonconforming building where it is otherwise not permitted; a special exception, pursuant to §139-90.B(2) (Nonconforming buildings or uses; Extension), and a variance from the 50% limitation in subsection (b), to permit the construction of an addition to the existing nonconforming dwelling in excess of 100% of the footprint of the existing nonconforming structure, for the property located at 15 Duffryn Avenue, Malvern, being UPI No. 54-1P-39, in the R-3 Residence District; and such further relief as may be necessary. This matter was heard by the Board on August 27, 2025 and the record was closed. The Board will vote on the relief requested, as amended, and no further evidence or testimony will be received on this matter.
Application Z-11-25: Application of Willistown Senior Apartments, LLC which appeals a zoning officer determination, pursuant to §139-123 (Functions: appeals from Zoning Officer), regarding the designation of Industrial Boulevard as a collector street. Alternatively, the Applicant seeks a variance from §139-75.C (Area, height and special design regulations) to permit the construction of Phase 1 of an age-restricted apartment building with an approximately 57 foot building setback and to permit a patio and gazebo to be located within the 57 foot building setback, where a 75 foot setback from the street line is otherwise required. The Applicant also seeks variances from §139-98.G (Off-street parking space; Residential Parking Requirements) to permit approximately one parking space per dwelling unit where two parking spaces per dwelling unit are required, if necessary; §139-75.2.B(5)(Age Restricted Apartment Development Option) to permit an age-restricted apartment development with a minimum age qualification of 62 years old, where 55 years old is the minimum permitted age qualification; and §139-158 (Natural Resource Protection and Density Calculations), which incorporates the provisions of Chapter 73, Article IV (Conservation of Valued Woodlands and Other Vegetation) of the Willistown Township Code, and requires the replacement of trees having a 6-inch caliper with new plantings. Applicant is the equitable owner of the properties located at 27-29 Industrial Boulevard, being UPI Nos. 54-1-2.12 and 54-1-2.13, in the I – Restricted Industrial District; and such further relief as may be necessary.
Application Z-12-25: Application of Michael D. O’Mara which seeks a variance from §139-159 (Riparian Buffer Area (RBA) Conservation District) of the Zoning Ordinance, which incorporates the provisions of Chapter 73, Environmental Protection, Article XII (Riparian Buffer Area (RBA) Conservation District) of the Willistown Township Code, to permit a previously constructed patio and storage shed within the Zone 2 Riparian Buffer Area, where they are not otherwise permitted under §73-62.B.(1)(Permitted uses) for the property located at 2 Pond Lane, being UPI No. 54-3-237, in the RA – Residence District; and such further relief as may be necessary.
